Commercial leases are commonly drafted to reflect the different types of letting involved: office, retail or industrial. They can relate to a single or multi-let. There is also a distinction between short-term lettings, being a term of less than five years, and leases for longer terms.
It is essential to obtain legal advice on a commercial lease. Leases of this nature are drafted by the landlord’s solicitor and the terms can vary. For example, a short-term lease does not usually contain a rent review clause and repairing covenants will normally apply to the interior of the premises only. Leases for longer periods will contain rent review and ‘break’ clauses and the tenant will normally be obliged to repair both the interior and the exterior of the premises. Therefore, it is important that the draft lease incorporates the correct and relevant clauses to ensure that your interests are protected.
