When a dispute or grievance arises between an employer and employee, (or indeed between employee and employee), it is essential that the employer adopt fair procedures before making a decision to take disciplinary action. Failure to adopt fair procedures usually results in industrial relations problems and possibly a claim for compensation e.g. for unfair or wrongful dismissal.
In all cases, the basis for disciplinary action should be clear and the range of penalties should be well defined with an internal appeal mechanism in place. The employer should have and abide by a set of disciplinary procedures which should be referred to in the employee’s contract of employment and be in writing and distributed to all employees.
