What does this mean?

A Separation Agreement is for couples who intend to separate. A couple can agree the terms of their separation, either voluntarily (by the couple themselves or through mediation) or through solicitors. The terms of settlement, setting out their future rights and duties to each other, are then put in writing in a Separation Agreement. This is a legal written contract between both parties to the marriage, setting out their future rights and duties to each other.

 

It assumes that the other party does not formally object to the separation. Terms of settlement may or may not have been agreed prior to consultation with your LawPlus solicitor.

 

What is included?

Your solicitor will draft a separation agreement on the basis of the agreed terms for your signature. If terms have not been agreed between the parties then your solicitor will negotiate the best possible terms for you.
