Although the internet and e-mail applications are valuable work tools, they are also open to abuse by employees and are a source of exposure for employers e.g. if e-mails are circulated which are of a sexual nature or are defamatory, the employer may be held liable in any legal action which may result. It is up to each employer to decide whether and to what extent each employee should have access to internet and e-mail and it is important that each employer draws up a policy and that each employee is made aware of the employer’s policy in this area.

 

As the implementation of a policy may involve some monitoring of an employee’s use of the internet/e-mail, it is important that account is taken of the data protection principles and an employee’s right to privacy in the workplace when the policy is being drawn up.
